These terms and conditions constitute a contract between happyhouse.shop hereinafter referred to as ¨The Website¨ owned by the entity Advarto Trading Limited, with tax identification number HE424161 and registered address at Markou Drakou, 18 Parkekklisia, 4520, Limassol, Cyprus, hereinafter, "The Company" and you, the user hereinafter referred to as ¨The User¨. By making purchases of goods and/or services on our website, you acknowledge that you have the legal capacity to enter into this contract according to the laws of your country of residence. This contract applies to all individual contracts for the purchase and sale of specific goods and/or services ordered by you, with each transaction being documented through an invoice or receipt.


1.Purpose of the Contract:

  1. 1.1. By accepting this contract, you agree that happyhouse.shop will provide products (physical and/or digital) and/or services that you choose to acquire from the available options on the website. You are obliged to pay the specified price for each product or service selected.

  2. 1.2. All the Users of the Website have the option to purchase the products of their choice offered on the Website, or to become members of the loyalty or membership program, making recurring credit top-ups to benefit from more advantageous conditions, as described below.

  3. 1.3. The website offers a range of goods and services, with availability and stock levels subject to the Company's discretion. Prices for products may vary for member and non-member users, and all prices will be subject to market fluctuations and third-party supplier offers.

2.Goods Delivery

  1. 2.1. Delivery times for each product are indicated on the website, typically ranging from 2 to 7 working days, unless stated otherwise explicitly. Delivery will be completed within a maximum period of 30 calendar days from the order placement. Professional carriers will deliver the products to the address provided during checkout. If a product is not delivered within the agreed period, it is your responsibility to inform the Company.

  2. 2.2. The Company reserves the right to subcontract third-party suppliers for product distribution and services, including transport.

  3. 2.3. Upon delivery, the risk associated with the products transfers to you. You will acquire ownership of the products either upon the Company's receipt of full payment, including shipping costs, or upon delivery, if the delivery occurs later.

  4. 2.4. The User will be responsible for any expenses incurred from failure to accept the product in case such product is lost or damaged as a result of such action.

  2. 3.2. Please note that certain digital products, like "license keys" or "activation keys," are limited to one purchase per user account unless explicitly stated otherwise.

  3. 3.3. Once you've made a purchase, you'll receive an order confirmation email containing activation instructions for your digital products. If, for any reason, you don't receive the instructions, don't hesitate to reach out to our customer services team for assistance.

  4. 3.4. The beauty of digital products lies in their instant availability. As soon as you activate your license key or download the digital product from our website or via email, it becomes ready for immediate use. Due to this nature, we do not offer returns or refunds for digital products.

  5. 3.5. If you encounter any issues with receiving your digital product due to email-related problems, our customer service department is here to help you resolve any such difficulties.

  6. 3.6. We take pride in maintaining a fair and secure shopping environment. Therefore, we reserve the right to cancel orders for digital products if we observe any activity that is abusive, fraudulent, or violates our terms and conditions.

4.Loyalty or Membership Program

  2. 4.2. Once you become a member, you commit to purchasing the corresponding amount of credits or bonuses every 14 days, as outlined in the membership plan of your choice, available on happyhouse.shop or through other marketing offers.

  3. 4.3. Becoming a member is easy. You can follow the procedures listed on our website or purchase any product at the membership price, accepting the conditions of our loyalty program.

  4. 4.4. Along with our standard plans, happyhouse.shop introduces a Custom Membership Plan to deliver greater flexibility and control. Users can personalize core features pricing and renewal frequency choosing any price from 5€ to 70€ and a renewal window between 7 to 60 days to fit their needs.

  5. 4.5. Unless otherwise declared, the general terms applicable to standard memberships credit accrual, plan validity, renewal rules, and cancellation rights apply to the Custom Membership Plan.

  6. 4.6. Custom Memberships are activated and renewed using the same mechanisms as standard plans. These mechanisms are fully described at checkout and governed by the Website’s Terms and Conditions. By enrolling, users accept the specific terms provided at purchase and the general Terms and Conditions.

  7. 4.7. Your convenience is important to us. You have the flexibility to change your membership plan to a lower or higher one anytime from your personal account. Such changes will take effect from the next automatic payment charge. Given the case, the User does not pay the full price of their membership plan on the date payment is due, they will be automatically demoted to the membership plan immediately below, and will in any case be able to access the most affordable membership plan, which has a recharge cost of 8.62€ .

  8. 4.8. With your membership, you will enjoy automatic credit reloads every 14 days. For each euro recharged (or the equivalent currency at the applicable exchange rate), you'll receive one credit.

  9. 4.9. Keep track of your credits in your personal account on the website. Remember, these credits are valid for 90 days from the date of acquisition, after which they will expire and cannot be used to exchange for products on our website.

  10. 4.10. Each automatic credit top-up will be confirmed with a notification of the payment made.

  11. 4.11. Should you wish to skip the next automatic credit recharge to your membership plan, you can easily do so by selecting this option in your personal account before the scheduled recharge date.

  12. 4.12. To cancel your membership plan, simply use the "Unsubscribe" or "Cancel" function in your personal account or reach out to our customer service team. Cancellation will take effect after 14 days.

  13. 4.13. If you prefer an immediate cancellation without the 14-day waiting period, you may do so by choosing this option in your personal account .

  14. 4.14. Once your membership is cancelled, any benefits associated with it will cease, however, any active credits left in the user account will remain valid and usable until their stated expiration date.

  15. 4.15. Enjoy trial periods for various membership plans. If you decide not to continue with the membership after a trial period, be sure to cancel it before the trial period ends to avoid future credit reloads based on the selected plan.

  16. 4.16. We may extend promotional offers, including free or reduced-price redeemable credits as a welcome gift. The applicable prices and plans will always be shown on happyhouse.shop and in any marketing offers. Please note that such credits are subject to expiration based on the membership plan and probationary period.

  17. 4.17. As part of our dedication to providing excellent value, we may offer promotional discounts on the first shipment of products to our member users.

  18. 4.18. We conduct promotional and marketing activities through third-party companies.

5.Digital Gift Cards

  1. 5.1. By purchasing a Gift Card or participating in a promotion, you agree to our Terms and Conditions and Membership Program, including recurring billing. This grants you full access to member benefits, as detailed in our Terms and Conditions.

  2. 5.2. As a valued member, you'll continue to enjoy the same benefits and terms you've previously agreed.

  3. 5.3. You may choose from a variety of Gift Card denominations, starting at 0.1€ until 100€ or local currency equivalent. Each transaction is limited to a maximum purchase of 100€ or local currency equivalent.

  4. 5.4. Your Gift Card balance will be automatically added to your account for your next purchase. Your balance will expire 90 days after purchase.

  5. 5.5. Gift Cards are for your personal use only and cannot be transferred, resold, or exchanged for cash. They can only be used on our Website.

  6. 5.6. Gift Card usage may be subject to promotional or seasonal restrictions.

  7. 5.7. Gift Cards must not be used for illegal or fraudulent purposes. By using a Gift Card, you agree that it must not be used in any manner that is misleading, deceptive, unfair, or otherwise harmful to happyhouse.shop, its partners, or its customers. We reserve the right to void Gift Cards without notice if we suspect fraudulent activity.

  8. 5.8. To ensure a secure shopping experience, Gift Cards can only be purchased through our Website or authorized promotions. Ownership of the Gift Card transfers to you upon purchase. Please note that purchased Gift Cards are non-refundable.

6.Price and Taxes

  7. 6.7. For orders shipped to non-EU countries, please be aware of potential import duties and taxes that may be charged upon the package's arrival at its destination. Any additional costs resulting from customs clearance will be the responsibility of the User. Each country has its own import policies, and it is essential for the User to comply with their country's regulations.

  8. 6.8. In our efforts to be eco-friendly, we provide invoices and receipts for purchases electronically, reducing paper consumption and benefiting the environment.

7.User Return Policy

  1. 7.1. Your satisfaction is important to us. Should you wish to exercise your right of withdrawal, you have 14 calendar days from the receipt of the purchased products to return them. To initiate the process, simply contact our customer service email.

  2. 7.2. While we strive for seamless returns, please note that the Company reserves the right not to partially or fully refund products that show damage caused by the User or products that cannot be returned due to hygienic or health reasons, if they have been unsealed.

  3. 7.3. We aim to process returns promptly. Within 14 days of receiving and inspecting the returned goods at our facilities, or from the date of your communication if physical return is not necessary, we will process the refund.

  4. 7.4. We understand the importance of flexibility in refund methods. The refund will be executed through the same payment method used by the User. Depending on the circumstances of each case, the Company may consider more flexible options for refunds. In cases where the User has used credits for partial payment, the same amount of credits will be refunded.

  5. 7.5. For smooth customs clearance, the User is required to provide all necessary information and documents for shipment completion.

  6. 7.6. Transparency is essential in addressing any issues. Should you detect any defect, damage, or discrepancy in the received product or an incorrect quantity of products, kindly inform the Company as soon as reasonably possible.

  7. 7.7. To validate your claim, please provide a photograph of the incorrectly received product or a photograph that clearly shows visible damages or defects.

  8. 7.8. In case a defect is not immediately noticeable, we appreciate your timely communication upon detection. Your collaboration in providing the required information will aid our investigation into any suspicions of defect or damage.

Transport costs for returns will be borne by the User if they are not a member of our membership program, and by the Company if they are.   10. 7.10. We value your trust in us, and we assure you that amounts paid for the purchase of credits are non-refundable unless an error occurred on the part of the Company, and the User did not consent to the purchase.

Returning a product partially paid for with credits will result in the refund of the used credits, and if applicable, the refund of the amount paid using another payment method, which will be returned to the same means of payment. In such cases, the User will regain a 90 day validity period for the refunded credits.

  12. 7.12. To maintain a smooth experience for all customers, digital products (such as license keys, e-books, etc.) are non-refundable once activated or downloaded, as this marks the moment the User gains access to the contracted digital product. The User acknowledges that their right to withdraw from the contract is forfeited once they can make use of the digital product, except in cases of defects.

8.Privacy and Personal Data Protection

  1. 8.1. At happyhouse.shop, we value your privacy and protect your personal data with utmost care. By using our services, you provide consent for the Company to process your personal data as outlined in our comprehensive privacy policy available on happyhouse.shop. This data processing is crucial for the seamless execution of this contract and to ensure a positive user experience.

If you reside in a European Union member state, your rights are covered by the General Data Protection Regulation (EU Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data) and its implementing regulations.

9.Liability

  1. 9.1. The Company, while committed to providing exceptional service, shall not be held liable for any changes in prices, taxes, or duties applicable to our products or any product unavailability.   2. 9.2The Company is not liable for any unlawful behavior, fraud, or misrepresentations by third parties concerning Gift Cards not issued by us. We encourage you to contact our customer service right away if you have any concerns about impersonation or fraudulent activity.

  3. 9.3 It is essential for Users to be vigilant in checking their email inbox and ensuring that our communications are not ending up in their spam folder.

  4. 9.4. The guarantee offered by the Company on its products may vary depending on whether the User is a "consumer" or acting within the context of their professional activity, in accordance with the applicable European Directive 2019/771. Consumer rights are protected by legal guarantees of 2 or 3 years, depending on their country of residence.

  5. 9.5. Our website may contain hyperlinks leading to third-party web pages. While we strive to provide reliable links, the Company cannot be held responsible for the content of those external pages.

10.Fraudulent or Abusive Activity

  2. 10.2. When you use a Gift Card, we kindly ask that you do so in a way that is honest, fair, and respectful to happyhouse.shop, our partners, and our valued customers. We reserve the right to void Gift Cards (including any associated happyhouse.shop Balance) without notice and without a refund. If we suspect any fraudulent or unlawful use, we may also suspend or terminate accounts, limit orders, and charge alternative payment methods.

  3. 10.3. In cases of suspicious transactions, the funds will be returned to the original payment method used by the User.

  4. 10.4. If you suspect any fraudulent or abusive activity in your account, please promptly contact our customer service team. We will investigate the case thoroughly and work to resolve the situation.

  5. 10.5. To ensure fair practices, the creation of multiple user accounts is limited to one per person and two per IP address. Any violation of this policy may lead to the termination of associated user accounts.

13.Assignment of Contract

  1. 13.1. The Entity reserves the right to assign the rights and obligations arising from its contractual relationship with the User to any natural or legal person it deems appropriate. In such cases, the Entity will communicate this assignment to the User.

  2. 13.2. The User may not transfer or assign the contract or any of the rights or obligations derived from it without the prior written consent of the Company.

14.Applicable Law and Jurisdiction

  1. 14.1. These terms and conditions will be governed and interpreted in accordance with the laws corresponding to the registered address of the Entity.

  2. 14.2. Any conflict in the application or interpretation of these terms and conditions shall be resolved by the Judges and Courts that pertain to the registered address of the Entity.

  3. 14.3. If the User is a consumer and resides in one of the Member States of the European Union, they may also choose to apply the jurisdiction of their country of residence and any mandatory provisions of their country's legislation.

  4. 14.4. In the event of any dispute related to compliance with these terms and conditions, both parties agree to attempt an amicable resolution in good faith before considering any other means of dispute resolution.
